All payments are non-refundable once work has commenced or materials have been procured, unless otherwise specified in the service agreement.

All content on the VirdraHerbaltik website, including text, graphics, logos, images, videos, blog posts, and design concepts, is the property of VirdraHerbaltik or its content suppliers and is protected by international copyright laws. You may not reproduce, distribute, modify, display, perform, publish, or create derivative works from any part of this website without our prior written consent.
Any garden designs, plans, or concepts created by VirdraHerbaltik for a client remain the intellectual property of VirdraHerbaltik until full payment for the services is received. Upon full payment, the client is granted a non-exclusive license to use the design for the specific property for which it was created. VirdraHerbaltik reserves the right to use images and descriptions of completed projects for promotional and portfolio purposes, unless otherwise agreed upon in writing with the client.
The VirdraHerbaltik website and Services are provided on an "as is" and "as available" basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
VirdraHerbaltik does not warrant that the website will be uninterrupted, secure, or error-free; that defects will be corrected; or that the website or the server that makes it available are free of viruses or other harmful components. We do not warrant that the results that may be obtained from the use of the Services will be accurate or reliable.

Our total liability to you for any and all claims arising out of or relating to these Terms or your use of the Services, whether in contract, tort, or otherwise, will not exceed the amount paid by you to VirdraHerbaltik for the specific service from which the liability arose, or USD $100.00 if no such payment has been made.
You agree to defend, indemnify, and hold harmless VirdraHerbaltik and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of (a) your use and access of the Service, by you or any person using your account and password; (b) a breach of these Terms; or (c) your violation of any rights of a third party, including without limitation any Intellectual Property Rights or privacy rights.
These Terms shall be governed and construed in accordance with the laws of the Country of Earth, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Botanical City, Country of Earth.
If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have had between us regarding the Service.
